A lawsuit filed in New York state alleges that Hershey's chocolate products "contain unsafe levels of lead and cadmium.

Christopher Lazazzaro of New York filed the lawsuit in federal court on Long Island on December 28.

The lawsuit makes reference to recent results by Consumer Reports (CR), which tested 28 dark chocolate bars for lead and cadmium.

According to the magazine, 23 of them, including Hershey's, Godiva, and Lindt chocolate, contained "comparatively greater levels" of the metals.

Hershey's Special Dark chocolate and Lily's 70% bar were particularly high in lead, while Lily's 85% bar was high in both lead and cadmium.

At least $5 million in damages, including at least $500 per transaction, are demanded in the lawsuit.
